小城上演 Jarndyce v Jarndyce,家翁敗訴。小城小記,引經據典,教化小民: 《信報》2006年10月26日 根據二零零五年版的法律權威書籍《Archbold》,助訟涉及非法協助他人打官司,「包攬訴訟」則是助訟中較嚴重中的一種,因涉及在官司勝訴後攤分利益,是《普通法》的刑事及侵權行為,源自中古,針對當時有權勢貴族透過資助官司欺壓平民百姓的行為,「包攬訴訟」在英國雖已廢除,但香港仍適用。 以「不成功、不收費」作招徠的律師或索償代理,便涉及「包攬訴訟」,近年法律改革委員會希望放寬,容許部分案件可採此收費模式,遂向公眾諮詢。 試找出十個不同之處: 《蘋果日報》2006年10月26日 根據05年版的法律權威書籍 Archbold ,包攬訴訟是助訟(maintenance)的一種,助訟者以非慈善目的,非法資助訴訟,影響他人權益,兩者均源自中古的普通法,針對當時權貴透過資助官司欺壓平民百姓,既屬刑事,亦是民事侵權行為,英國於1967年立法廢除,香港仍適用,但沒有案例。 以「不成功、不收費」作招徠的律師或索償代理,便涉及包攬訴訟,近年法律改革委員會打算容許某些性質的案件採用這種收費模式,已向公眾作出諮詢。 《蘋果日報》還聲明「本報訊」呢!真是鏗鏘得可以。 Propaganda masquerading as education,橋唔怕舊也。 都說傳媒是社會公器。你可以借報紙宣揚「包攬訴訟」罪過。我也可在報紙發表「公民抗命」宣言。 這場 propaganda war 永遠打不完,小城記者最幸福。搬字過紙罷了,仲敢怨人工低!
